This privacy policy (“Policy”) describes the commitment that Lightspeed GMI Limited – which operates MySurvey – and our sister company, Compete, Inc. – compete.com (Lightspeed and Compete together called the “Partners” herein) make to protect your privacy.  Lightspeed and Compete are both businesses within the Kantar (kantar.com) research organization.  This policy applies to all Lightspeed panel members who agree to participate in this specific research program (“Program”) that involves downloading and installing to their computer a small software application (“Application”) operated by Compete that records their internet activities.  This policy does not replace the existing MySurvey privacy policy as that still applies to all Lightspeed panel members, whether or not they choose to participate in this Program.  This privacy policy is supplemental to the MySurvey policy and applies to only those panel members who choose to participate in the Program.

  1. Our Commitment to Your Privacy

    • Your privacy will be respected and the data collected will be maintained and used only as described in this Policy.
    • Your personal information will only be used as described in this Policy and will not otherwise be disclosed to anyone without your consent except as otherwise described herein.
    • We will clearly represent to you what we are doing through this Program.
    • Our market research is not a guise to sell you something or to ask for money.
    • You are free to uninstall the Application at any point and discontinue the future collection of your data collected through the Application.
    • We will do our best to make your participation in this Program a pleasant experience.

  2. What Information Will We Collect?

    By participating in this Program, you are agreeing to allow the Partners to collect and analyze data related to your internet or online activities.  Using the small piece of software you download (Consumer Input Software), we collect from your computer what is known as click stream data.  Click stream data includes information such as your IP address, the URLs (generally the address information) of websites you have viewed (and any information those the webpage you’re viewing places in those URLs), the date and time you viewed the web pages, the duration of each visit and the search terms you entered on any webpage that enables online search.
    The Application uses a proprietary privacy rules engine to search through all click stream data to strip out personally identifiable information before such data is sent to Compete’s database or servers.  If any personal information is inadvertently collected by the Application, we make reasonable efforts to purge our database of that information promptly.
    Just as our panelists’ survey responses are not tied to any personal information when aggregated information is disclosed to clients or third parties, the click stream data we collect is not associated with any personally identifiable information when shared with clients or third parties.  As with survey responses, panelists’ internet activities are shared only in an anonymous fashion to help our clients improve their products and services or their marketing communications.
    To be clear – in addition to the information that we are collecting through this Application, we will continue to collect other information, such as survey responses, as outlined in the policies relevant to your existing member relationship with MySurvey.   Information obtained through the Application may be used jointly with other information collected in accordance with your existing MySurvey membership or publicly available information.
    Be assured that your data will never be licensed, published, sold or otherwise shared with clients or third-parties in a way that identifies you personally.

  3. How Will We Use This Data?

    The data that we collect is used in an anonymous manner to understand how consumers interact with the Internet and how our clients fashion or improve their products, services or marketing initiatives.  The Internet activity information collected may be joined with applicable survey responses or demographic information that you provide. The joined information is anonymized before sharing with third-parties outside of the Partners.  The Internet activity information may also be used by MySurvey to identify relevant panelists for participating in specific surveys.
    Information about internet activities is collected from the computer on which you download and install the Application.  The data is then securely transmitted to a data collection server and database located in the United States at Compete.  This transmission of this data is subject to all Safe Harbor rules and regulations.  As described above, reasonable effort is made to strip personally identifiable information from the data before transmission.
    Once the data is in Compete’s database, it is made available only to the Partners’ employees or contractors in the context of conducting analysis.  As described above, the data and analysis that is shared with clients is in anonymized form.  Individual answers to questions may be shared with our clients (for example) but those answers will not be labeled with, or linked to, your personal information.  This data is never used for the purposes of targeted marketing or the direct sale of any product or service.
    We will never sell your personal information to any third party.  However, to the extent permitted by law, personal information may be transferred to another company if there is a sale or merger affecting the Partners. Please note that we reserve the right to access and/or disclose personal information and aggregate information we gather as required by courts or administrative agencies and to the extent required to permit us to investigate suspected fraud, harassment or other violations of any law, rule or regulation, Terms and Conditions, or the rights of third parties or to investigate any suspected conduct which we deem improper.
    Data will be retained in the form described above for as long as commercially necessary for business purpose or five years, whichever is shorter.  After a maximum of five years, the data will be deleted or kept in a form that removes it from being identified with your personal information.
    You may opt out from continued data collection at any time in accordance with the “How Can You Terminate Your Participation?” section below.

  4. How Do We Keep This Data Secure?

    We are committed to using our best efforts to maintain the security of your personal information. To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, we have put into place physical, administrative, operational and technical procedures to help safeguard and secure the information we collect, including an industry-standard firewall security system. Though we use our best efforts to protect the security of your personal information and our system, due to the inherent open nature of the Internet, no transmission via the Internet can be guaranteed to be 100% secure. As a result of this and other factors beyond our control, we cannot guarantee the security of the information transmitted through channels not directly controlled by us. Therefore, you assume this risk by using our service.

  5. How Will We Notify You of Changes to This Policy?

    If we change our position and intend to use your personally identifiable information in a manner different from that stated in our privacy policy at the time of collection, we will notify you via email. You will have a choice as to whether or not we use your information in this different manner; instructions for how to make that choice will be included in the email. If we make any material changes to our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on our website notifying our members that there is a change and pointing them to the revised privacy page.

  6. How Can You Terminate Your Participation?

    To opt-out or withdraw from participating in this Program, you can remove the software application as follows:

    Microsoft Internet Explorer:
    1. From the Windows control panel, select “Add / Remove Programs”
    2. Select the “Consumer Input Software” entry.
    3. Select the “Remove” button.
    4. Select the “Uninstall” button from the dialog that appears.
    5. Follow the instructions presented in the Consumer Input Software Uninstallation Program
    Mozilla Firefox:
    1. From the Firefox “Tools” menu, select “Add-ons”.
    2. From the Add-ons menu, select the “Consumer Input Software” entry.
    3. Select the “Uninstall” button.
    4. Select the “Uninstall” button again to verify.
    5. The Consumer Input Software will be completely removed the next time Firefox is restarted.

    By participating in this Program, you authorize the export of Personal Information to the USA and its storage and use as specified in this policy. If you are not a U.S. citizen, you expressly consent to the processing of your personal information in accordance with this Privacy Policy, even if the laws in your country may be more stringent with respect to the processing of personally identifiable information.
    We participate in the EU Safe Harbor Privacy Framework as set forth by the United States Department of Commerce. As part of our participation in the safe harbor, we have agreed to TRUSTe dispute resolution for disputes relating to our compliance with the Safe Harbor Privacy Framework. If you have any complaints regarding our compliance with the Safe Harbor you should first contact us (as provided above). If contacting us does not resolve your complaint, you may raise your complaint with TRUSTe by Internet or by fax at 415-520-3420, or mail at Watchdog Complaints, TRUSTe, 55 2nd Street, 2nd Floor, San Francisco, CA, USA 94105. If you are faxing or mailing TRUSTe to lodge a complaint, you must include the following information: the name of company, the alleged privacy violation, your contact information, and whether you would like the particulars of your complaint shared with the company. For information about TRUSTe or the operation of TRUSTe’s dispute resolution process, see http://watchdog.truste.com/pvr.php?page=complaint or request this information from TRUSTe at any of the addresses listed above. The TRUSTe dispute resolution process shall be conducted in English.
